Terms of Use

These Terms of Use (“Terms”) govern your use of the Explain the Card iOS application (“the App”), provided by Danny Hollek (“we”, “us”, “our”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The service

Explain the Card identifies Magic: The Gathering cards via your device camera and provides:

No account or sign-in is required; the App operates under an anonymous identity created automatically on first launch (see the Privacy Policy).

2. AI-generated content — accuracy and intended use

The App's explanations are produced by a third-party generative AI model (Google Agent Platform / Gemini), grounded in card text and rules excerpts. You acknowledge and agree that:

Before any AI feature sends data off your device, you must explicitly consent via the in-app disclosure (see the Privacy Policy, §2). Do not enter personal or sensitive information into the question field — enter only rules questions.

3. Card data and Wizards of the Coast

Magic: The Gathering card data displayed in the App — including card names, oracle text, mana symbols, rulings, and card images — is the property of Wizards of the Coast, LLC.

The literal and graphical information presented in this app about Magic: The Gathering, including card images, the mana symbols, and oracle text, is copyright Wizards of the Coast, LLC, a subsidiary of Hasbro, Inc. Explain the Card is not produced by, endorsed by, supported by, or affiliated with Wizards of the Coast or its parent company Hasbro, Inc.

The AI-generated explanations themselves are our original content and are protected by copyright. You may use them for your personal, non-commercial reference. You may not scrape, resell, or redistribute the App's AI output at scale, or use it to build a competing service.

4. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, in accordance with these Terms and the Apple Media Services Terms and Conditions. You may not copy, modify, reverse-engineer, or attempt to circumvent the App's security or metering mechanisms, except to the extent such restriction is prohibited by applicable law.

5. Free use, metered AI, and purchases

Scanning cards and viewing card data (oracle text, rulings, legalities, combos) and your history are free and unlimited.

AI generation is metered. Each AI explanation, interaction analysis, or Q&A answer consumes one AI call:

Prices are indicative and shown in your local currency at purchase; the price displayed at the time of purchase governs.

Subscription terms (auto-renewal)

Payments, refunds, and the Apple EULA

All purchases are processed by Apple; we do not handle payment details. Refunds are governed by Apple's policies and are requested through Apple, not us. Credits that are refunded by Apple are reversed in your in-app balance. Unless we provide our own end-user license agreement, the App and its in-app purchases are also governed by Apple's Standard Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/).

Availability of AI calls

AI features depend on third-party services and your internet connection. We do not guarantee uninterrupted availability of AI generation. If a generation fails (e.g. you are offline, the request is blocked by a safety filter, or quota is exceeded), the metered call is automatically refunded to your balance.

6. Acceptable use

You agree not to:

We may suspend access for an install that abuses the service or attempts to defraud the metering system.

7. Third-party services

The App relies on third-party services, each governed by its own terms and privacy policy: Google (including its Agent Platform / Gemini), Apple, and third-party card-data and rules providers. We are not responsible for the content, availability, or practices of these services.

8. Disclaimers

THE APP AND ALL CONTENT, INCLUDING AI-GENERATED EXPLANATIONS, ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or that AI output will be accurate or complete. Nothing in these Terms limits rights that cannot be limited under the consumer-protection laws applicable to you.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM YOUR RELIANCE ON AI-GENERATED CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR USD 25. Some jurisdictions do not allow these limitations, in which case they apply to the fullest extent permitted.

10. Changes

We may modify the App or these Terms. Material changes to these Terms will be reflected by updating the “Last updated” date above and, where appropriate, by an in-app notice. Continued use after changes take effect constitutes acceptance. Changes to AI data sharing additionally require renewed in-app consent (see the Privacy Policy).

11. Governing law

These Terms are governed by the laws of Germany, without regard to its conflict-of-laws rules, and subject to any mandatory consumer-protection rights of the country in which you reside.

12. Apple-required terms

These Terms are between you and us, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide support or maintenance for the App. In the event the App fails to conform to any warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
